Use of this tool
This diagnostic tool is designed to give guidance on a range of activities performed at or in relation to black coal mine sites to help you determine if your employee is an "eligible employee" for the purposes of the Coal LSL act for a particular month. It is not intended to be definitive and will not be able to cover all situations, particularly those where an employee’s fact pattern does not lead to a clear answer. We may need to have a further conversation with you regarding these circumstances to determine employee eligibility based on the totality of the circumstances.
Employee’s information
An employee’s eligibility for Coal LSL effectively needs to be assessed on a monthly basis for the purposes of submitting levy returns with relevant hours and eligible wages. It is important, however, that you input your what you believe and can substantiate to be your employee’s current overall work fact pattern with you as an employer rather than just the activities performed within that month.
Doing so will give a more consistent and accurate answer as to whether the employee is an eligible employee by considering the totality of their employment with you in determining what work they are doing in the black coal industry and on a black coal mine site.
